These Terms and Conditions form a binding agreement between Devone Calli, doing business as Beyond Travel (“Beyond Travel,” “we,” “us,” or “our”), and the traveler, purchaser, lead traveler, and every person for whom a booking is made under the reservation (“Traveler,” “you,” or “your”). By requesting a quote, authorizing a booking, signing an authorization, clicking acceptance, submitting payment information, paying an invoice, using any travel services, or permitting Beyond Travel to place a reservation on your behalf, you acknowledge that you have read, understood, and agreed to these Terms and Conditions on behalf of yourself and every traveler on the booking.

1. Role of Beyond Travel

Beyond Travel acts as an independent travel advisor and, except where expressly stated otherwise in writing, arranges travel services provided by third-party airlines, hotels, resorts, cruise lines, tour operators, destination management companies, transfer companies, excursion operators, insurance providers, and other travel suppliers (“Suppliers”). Beyond Travel is not the carrier, hotel, resort, cruise line, or operator of those services and is not responsible for the acts, omissions, insolvency, bankruptcy, delays, overbookings, cancellations, schedule changes, safety failures, or other conduct of any Supplier.

When Beyond Travel offers or hosts its own group trips, Beyond Travel may provide planning, coordination, hosting, administrative support, and related services, while underlying travel components may still be provided by third-party Suppliers subject to their own terms.

2. Incorporation of Supplier Terms

All reservations, travel services, packages, and travel components are subject to the terms, conditions, fare rules, cancellation rules, refund rules, liability limitations, and contract provisions of the applicable Supplier or Suppliers. Supplier terms are incorporated into this agreement by reference. If a Supplier imposes stricter limitations, change rules, baggage rules, refund rules, or documentation requirements than those stated here, the Supplier’s rules will control for that component.

3. Booking Authorization and Consent

You authorize Beyond Travel to research, quote, reserve, hold, confirm, modify, and cancel travel arrangements on your behalf based on the information and instructions you provide. You represent and warrant that:

  1. you are at least 18 years of age and legally authorized to enter into this agreement

  2. all information you provide is true, accurate, and complete

  3. any payment method used for the booking is lawfully yours to use or is used with the full permission of the authorized cardholder or account holder

  4. you have authority to act for every traveler on the reservation

  5. every traveler on the reservation has authorized you to accept these Terms and Conditions on their behalf

You agree that Beyond Travel may rely on your written authorization, e-signature, CRM acceptance, invoice approval, payment authorization form, email, text message, portal acceptance, booking confirmation response, recorded call where lawful, or other documented communication as evidence of your authorization and agreement.

4. Payment Authorization and Submission

When you provide payment information to Beyond Travel and authorize a transaction, you expressly direct Beyond Travel to submit that payment information to the relevant Supplier or booking platform for the approved travel purchase. You understand that, in many cases, payment is processed directly by the Supplier and not by Beyond Travel.

You authorize Beyond Travel to use the payment information you provide for the specific authorized transaction, including deposits, installment payments, final payment, approved add-ons, insurance if elected, changes requested by you, correction of occupancy-based repricing caused by cancellation of one or more travelers, and any stated administrative or professional service fees.

If payment is declined, reversed, disputed, blocked, or later determined by the Supplier to be invalid, Beyond Travel may treat the booking as unpaid, suspend further services, cancel the reservation if permitted, and pursue all remedies available under this agreement and applicable law.

5. Deposits, Installments, Final Payment, and Default

Unless otherwise stated in writing for a particular trip or promotion:

  • deposits are due at the time of booking

  • full payment is due no later than 45 days before travel commencement, unless a Supplier requires earlier payment or the booking is made within 45 days of departure, in which case full payment is due immediately

  • all prices are quoted in U.S. dollars unless otherwise stated

  • prices, availability, airfare, room category, taxes, fuel surcharges, government fees, and Supplier-imposed charges are not guaranteed until booked and accepted by the Supplier

If your balance is not paid in full by the due date, Beyond Travel may cancel the booking, treat the reservation as abandoned, impose applicable cancellation penalties, and retain any non-refundable amounts, service fees, planning fees, and other earned amounts.

6. Non-Refundable Deposits, Service Fees, and Planning Work

All deposits are non-refundable unless a refund is expressly recoverable from an applicable travel protection plan purchased by the traveler and actually paid by that protection provider. Beyond Travel’s planning, research, curation, consultation, administrative, hosting, booking support, change handling, and trip coordination work begins promptly after authorization and is earned when performed. Any professional service fee, consultation fee, planning fee, research fee, administrative fee, change fee, hosted group fee, or similar fee charged by Beyond Travel is non-refundable once the service has begun or the fee has been incurred, except where prohibited by law.

No refund will be owed for time spent researching destinations, reviewing supplier options, preparing proposals, coordinating rooming, collecting traveler details, communicating with Suppliers, or servicing the booking, even if you later cancel.

7. Cancellations by Traveler

All cancellation requests must be submitted in writing by the lead traveler from the email address on file to cancellations@BeyondTrav.com and are not effective until acknowledged by Beyond Travel in writing. Telephone calls, social media messages, text messages, or verbal statements do not constitute valid cancellation unless Beyond Travel confirms acceptance of the cancellation in writing.

If one or more travelers cancel from a shared room or package, pricing for the remaining travelers may increase immediately based on the new occupancy, room type, category, or Supplier rules in effect at the time of the change. You remain responsible for any resulting repricing, single-occupancy upgrade, or other additional amounts.

Beyond Travel may charge a cancellation administration fee in addition to Supplier penalties. Unless a stricter written trip-specific policy applies, the cancellation administration fee is:

  • $100 per traveler for cancellations more than 91 days before departure

  • $150 per traveler for cancellations 31 to 90 days before departure

  • $200 per traveler for cancellations 30 days or less before departure

These administration fees are separate from and in addition to all Supplier penalties and any non-refundable Beyond Travel fees.

8. No Refund for Unused Services

No refunds, credits, or exchanges will be given for missed flights, missed transfers, denied boarding, early departure, no-shows, partially used vacations, skipped excursions, unused hotel nights, unused meals, unused resort amenities, or any other unused travel component, whether voluntary or involuntary, except where the applicable Supplier expressly provides otherwise in writing.

Complimentary items, promotional amenities, bonus features, or free inclusions offered by a Supplier have no cash value and are not refundable, replaceable, or guaranteed by Beyond Travel.

9. Changes Requested by Traveler

Any change requested by you after booking, including travel dates, names, rooming, room category, departure city, destination, supplier, itinerary, occupancy, transfer option, excursion selection, or insurance election, is subject to Supplier approval, current pricing, any applicable fare difference, change penalties, cancellation penalties, and Beyond Travel’s service or change fees. Quotes are not guarantees. Pricing may increase materially by the time a change is processed.

10. Travel Protection and Insurance

Travel insurance and trip protection are strongly recommended for every traveler. If you decline travel insurance or protection, you accept full financial responsibility for losses associated with cancellation, interruption, delay, medical events, missed connections, supplier default, weather events, baggage loss, illness, injury, quarantine, government restrictions, and other unforeseen events. Beyond Travel is not an insurer and does not guarantee that any loss will be covered by a policy or protection product.

If insurance or protection is available for your booking, you are responsible for reviewing the policy terms, exclusions, deadlines, covered reasons, claim procedures, and documentation requirements before purchase.

11. Travel Documents, Entry Requirements, and Traveler Responsibility

You are solely responsible for obtaining and carrying all required travel documents and for satisfying all entry, exit, transit, health, vaccination, testing, age, and identification requirements for each destination, point of connection, and return segment of travel. These requirements may change at any time and may vary based on citizenship, residency, age, itinerary, and mode of travel.

For domestic air travel, all travelers must present identification acceptable to the airline and government authorities. For international travel, all travelers, including minors and infants, are responsible for having valid passports and any required visas or travel authorizations. Passports should be valid for at least six months beyond the date of return unless a destination permits otherwise. Non-U.S. citizens are solely responsible for verifying all required immigration documentation.

If a traveler is denied boarding, denied entry, detained, fined, delayed, or deported because of missing, invalid, damaged, mismatched, or insufficient documentation, no refund will be owed by Beyond Travel.

The name on the reservation must match the traveler’s government-issued travel identification exactly. Name corrections may be impossible or may require cancellation and rebooking at the traveler’s expense.

12. Review of Documents and Duty to Report Errors

You must review all confirmations, invoices, itineraries, passenger names, dates, rooming, destinations, and travel documents immediately upon receipt and report any error or discrepancy to Beyond Travel in writing within 24 hours. Failure to do so may result in additional costs, inability to correct the issue, cancellation penalties, or complete loss of the booking. Beyond Travel is not responsible for losses arising from your failure to promptly review documents.

13. Air Travel, Schedules, and Supplier Changes

Airline schedules, aircraft types, routings, seats, terminals, departure times, baggage allowances, and operating carriers may change before or during travel. Beyond Travel does not control and is not responsible for airline schedule changes, flight cancellations, missed connections, seat assignments, overbooking, irregular operations, baggage charges, denied boarding, or ancillary airline fees.

Hotel room assignments, bedding, location within the property, adjoining rooms, views, upgrades, and specific room requests are subject to Supplier availability and discretion and are never guaranteed unless the Supplier expressly confirms that feature in writing.

14. Exclusions and Personal Charges

Unless expressly listed in your written quote or booking confirmation, your trip price does not include resort fees, city taxes, local taxes, energy surcharges, seat fees, baggage fees, meals, gratuities, excursions, optional tours, room service, minibar charges, laundry, spa services, parking, pet fees, security deposits, incidental holds, passport costs, visa costs, testing costs, vaccination costs, transportation not listed, or other items of a personal nature.

You are responsible for paying all incidental charges and all personal charges imposed by the Supplier before departure or checkout.

15. Hosted Group Trips and Conduct

For hosted or escorted trips, Beyond Travel may provide on-site support, group coordination, social activities, or host presence. This does not make Beyond Travel the operator of independent Supplier services. You agree to behave lawfully, respectfully, and safely at all times.

Beyond Travel reserves the right, in its sole reasonable discretion, to refuse booking, remove a traveler from a group, deny participation in an event or excursion, cancel future participation, or require a traveler to leave a trip, without refund, if the traveler engages in abusive, threatening, violent, discriminatory, intoxicated, unsafe, disruptive, harassing, or illegal conduct, or any conduct that jeopardizes the safety, comfort, rights, or enjoyment of others, harms the Beyond Travel brand or relationships with Suppliers, or creates unreasonable operational risk.

16. Lead Traveler Responsibility and Shared Bookings

The lead traveler is jointly and severally responsible for all payment obligations, representations, authorizations, rooming decisions, and communications relating to the reservation. The lead traveler represents that each traveler has agreed to these Terms and Conditions.

If a booking includes shared occupancy, invited travelers, roommates, or guests arranged through the lead traveler, the lead traveler accepts responsibility for the suitability and reliability of those invited travelers. If a chargeback, reversal, false dispute, or other payment misconduct is initiated by any traveler on the reservation or by any invited roommate or guest tied to the booking, Beyond Travel may enforce remedies against that traveler, the lead traveler, and any related traveler or roommate whose booking depended on or benefited from that payment, to the fullest extent permitted by law and this agreement.

17. Fraudulent Chargebacks, Payment Disputes, and Anti-Fraud Enforcement

You agree not to initiate a chargeback, reversal, retrieval request, dispute, or similar payment challenge for any charge that you authorized, any service that was delivered as booked or materially as described, any non-refundable deposit, any non-refundable Supplier charge, any earned Beyond Travel service or planning fee, or any cancellation penalty properly applied under these Terms and Conditions or Supplier terms.

You agree that the following may be used as evidence of authorization and performance in any dispute, arbitration, collections matter, or chargeback response:

  • signed authorization forms

  • invoice approvals

  • CRM acceptance logs

  • timestamps

  • billing address records

  • IP logs or portal records where available

  • email communications

  • text messages

  • booking confirmations

  • traveler information submissions

  • payment receipts

  • supplier confirmations

  • itinerary delivery

  • document delivery

  • use of any part of the trip or travel service

Use of any travel component, including flights, hotel nights, transfers, excursions, insurance, or hosted services, constitutes strong evidence that the transaction was authorized and that services were provided.

Before initiating any chargeback or payment dispute, you must first send written notice from the email address on file to Beyond Travel detailing the basis of your claim, attaching all supporting documentation, and giving Beyond Travel at least 15 calendar days to investigate and respond. This requirement does not waive any right you may have to report a true billing error or actual unauthorized use, but it does require you to give Beyond Travel an opportunity to cure, clarify, or document the transaction first.

A false, abusive, bad-faith, or fraudulent chargeback includes, without limitation:

  • claiming a charge was unauthorized when it was authorized by you or by an authorized lead traveler

  • claiming services were not provided when the booking was confirmed, documents were issued, or services were partially or fully used

  • disputing non-refundable deposits, earned fees, or cancellation penalties that were disclosed in advance

  • initiating a dispute after travel has commenced or after benefits of the booking have been received, absent documented fraud or documented non-delivery

  • asking a card issuer to reverse a valid charge instead of using the agreed cancellation or dispute process

If Beyond Travel reasonably determines that a chargeback or payment dispute is false, abusive, bad-faith, or fraudulent, Beyond Travel may, to the fullest extent permitted by law:

  1. contest the dispute and provide all relevant records to the card issuer, bank, processor, Supplier, insurer, arbitrator, or court

  2. suspend or cancel current and future bookings

  3. deny future services to the responsible traveler and related travelers on the booking

  4. report suspected fraud to the applicable Supplier, card processor, card network, bank, collection agency, legal counsel, and law enforcement or other authorities

  5. seek recovery of the disputed amount, chargeback fees, bank fees, administrative costs, internal staff time, collection costs, investigative costs, arbitration filing costs where recoverable, attorney’s fees where recoverable, and all other damages allowed by law

  6. pursue all available civil remedies and equitable relief

Nothing in this section limits Beyond Travel’s right to defend itself or pursue recovery arising from fraud, misrepresentation, unjust enrichment, conversion, civil theft where applicable, or other unlawful conduct, to the fullest extent permitted by law.

18. Complaints and Opportunity to Cure

If you believe a booked service is materially not as described, you must notify both the Supplier and Beyond Travel promptly while travel is in progress so that a reasonable opportunity to investigate and cure may be provided where possible. Failure to complain during travel may materially prejudice any claim later asserted.

Any post-travel complaint must be submitted in writing to Beyond Travel within 10 days after the end of travel, with supporting documents, photographs where relevant, and a detailed explanation of the claimed issue. General dissatisfaction, personal preference, weather, inconvenience, construction outside Beyond Travel’s control, Supplier staffing issues, or conditions disclosed in Supplier materials do not automatically constitute a service that was “not as described.”

19. Force Majeure

Beyond Travel is not liable for delay, cancellation, interruption, loss, damage, injury, additional cost, or failure in performance caused by events beyond its reasonable control, including weather, hurricanes, earthquakes, pandemics, epidemics, quarantine, public health events, acts of God, war, terrorism, civil unrest, riots, labor disputes, strikes, mechanical failures, airline disruptions, governmental actions, border closures, travel advisories, sanctions, power outages, cyber events, supplier insolvency, or any similar event. In such circumstances, refunds, credits, and rebooking rights will be governed by the applicable Supplier and any travel protection purchased.

20. Assumption of Travel Risk

Travel involves inherent risks that may vary by destination and activity. These risks may include illness, injury, accidents, crime, transportation disruptions, water activities, wildlife exposure, foodborne illness, political unrest, and reduced access to medical care. By traveling, you voluntarily assume these risks for yourself and for any minor traveler for whom you book.

21. Limitation of Liability

To the fullest extent permitted by law, Beyond Travel shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or emotional-distress damages, loss of enjoyment, lost wages, lost profits, loss of business opportunity, or similar damages arising from or relating to the booking or travel, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Beyond Travel’s aggregate liability, if any, for claims arising out of services provided directly by Beyond Travel shall not exceed the total amount of fees actually paid directly to Beyond Travel for its own services in connection with the specific booking giving rise to the claim, excluding amounts collected for or paid to third-party Suppliers.

22. Indemnification

You agree to indemnify, defend, and hold harmless Beyond Travel, its owner, agents, contractors, hosts, employees, and representatives from and against claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable attorney’s fees where recoverable, arising out of or related to your breach of these Terms and Conditions, your fraud or misrepresentation, your violation of law, your conduct during travel, your payment dispute or chargeback misconduct, or your acts or omissions causing loss to Beyond Travel or a Supplier.

23. Dispute Resolution, Mandatory Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, any booking, any quote, any travel services arranged or provided by Beyond Travel, any payment authorization, any cancellation or refund issue, any chargeback dispute, any alleged misrepresentation, or any relationship between you and Beyond Travel that cannot be resolved informally shall be resolved exclusively by binding individual arbitration, and not in court, except as otherwise expressly stated in this section.

This arbitration agreement is governed by the Federal Arbitration Act, which generally makes written arbitration agreements valid and enforceable.

The arbitration shall be administered by a nationally recognized arbitration provider selected by Beyond Travel, provided that the selected provider and the arbitration process comply with applicable law. If the selected provider is unavailable, unwilling to serve, or determined to be inappropriate under applicable law, the arbitration shall be administered by another nationally recognized arbitration provider or, if necessary, by an arbitrator appointed by a court of competent jurisdiction consistent with this agreement.

The arbitration shall be conducted in Essex County, New Jersey, unless applicable law requires a different consumer-compliant format, the administrator’s rules require remote proceedings, or the parties agree in writing to another location or remote arrangement.

Either party may seek temporary, preliminary, or injunctive relief in a court of competent jurisdiction only to preserve rights or property pending completion of arbitration. Either party may also bring an individual claim in small claims court if that claim qualifies and remains solely on an individual basis.

You and Beyond Travel each waive the right to a jury trial. You and Beyond Travel also waive any right to participate in a class action, collective action, representative action, private attorney general action, consolidated action, coordinated action, or mass arbitration proceeding, except to the extent such waiver is prohibited by applicable law. Arbitration shall proceed only on an individual basis. Class arbitration is permitted only if Beyond Travel expressly agrees to it in writing. Class arbitration generally depends on party consent rather than being presumed.

Nothing in this section shall require a consumer to pay arbitration fees, costs, or the opposing party’s fees or costs in a manner prohibited by applicable law. Under New Jersey law, a consumer arbitration may not require a consumer who does not prevail to pay the opposing party’s fees and costs solely on that basis.

24. Governing Law

Except to the extent preempted by federal law, these Terms and Conditions and any dispute between you and Beyond Travel shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

25. Electronic Records and Admissibility

You agree that electronic signatures, digital acceptances, CRM records, payment authorization forms, invoice approvals, email communications, text messages, and other electronic records may be used to evidence your agreement, your authorization, your receipt of disclosures, your acceptance of Supplier terms, and your acknowledgment of booking details. You agree that such records may be admitted in arbitration, court proceedings where applicable, chargeback responses, collection matters, and disputes as business records and evidence of the transaction to the fullest extent permitted by law.

26. Severability, Waiver, and Survival

If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver by Beyond Travel of any breach or right shall be deemed a continuing waiver. All provisions relating to payment obligations, non-refundable amounts, chargebacks, indemnification, limitation of liability, dispute resolution, and recordkeeping shall survive cancellation, completion of travel, or termination of the relationship.
